MUMBAI: Observing that touching the buttocks of a girl by uttering the words “you are very sexy, I feel like taking you away,” itself suggests that the accused had committed the act only with intent to commit sexual assault, a special Pocso court convicted and sentenced a 50-year-old man to three years imprisonment for harassing his 13-year-old neighbour in 2016.
The judge said that the accused had not brought any evidence to show that there was a dispute between victim and his family. “There seems no reason for the victim to lodge a false report against him. There is no evidence even to suggest that the police officer had any reason to prosecute him for commission of such offence,” the judge said.
The minor deposed before the court and submitted that she lived in the city with her maternal grandmother and uncle. She said that a month before the FIR was registered, the accused used to stalk her when she went for her tuitions. He used to touch her buttocks and kiss her on cheek. She told her maternal grandmother about the conduct of the accused, but the woman did not trust her because the family of the accused was very close to her.
Thereafter, she told her uncles about the conduct of accused. She said that they talked to the accused, but there was no change in his behaviour. The minor further said that on May 24, 2016, at at 7.39pm, she was standing with her friend near the house when the accused came from behind, touched her buttocks and said that she looks very hot, he wants to kiss her on her cheeks and he feels like taking her with him. On May 30, 2016, she went to the police station with her maternal uncle and filed an FIR.
The accused was arrested and subsequently granted bail. He claimed that there was a dispute on account of shortage of tap water supply, hence, he was falsely implicated.
